LABOR

TCRY & International Union of Operating Engineers (IUOE) Local 280 & Hanford Atomic Metal Trades Council (HAMTC) have signed a new long term agreement effective January 1, 2014.

TCRY has maintained a mutually beneficial relationship with the two organizations for the past fourteen years.

The Agreement embraces a strong commitment to safety, mutual fair dealing, employee welfare, growing and defending the railroad business as well as the Union jobs associated with that railroad business, improving cost efficiencies and maintaining operational flexibility for TCRY and its Employees.

The Parties have agreed that it is TCRY's right, and is in the best interest of the TCRY and its Employees, that TCRY be the sole provider of rail service to customers along and North of the railroad operated by TCRY.

The Agreement has been reached through the process of collective bargaining under the Railway Labor Act with the objective of serving these purposes.

TCRY recognizes IUOE Local 280 as the sole and exclusive bargaining agent for purposes of collective bargaining wages, hours of work and other terms and conditions of the Agreement.

HAMTC recognizes TCRY as a HAMTC represented Employer as referred to in any collective bargaining agreement to which HAMTC or any of its member unions is a party.

The Parties have agreed that TCRY is the successor to the Hanford Railroad previously operated by the Atomic Energy Commission and the Department of Energy and as such is the successor to the "Government Railroad."

And, the track on which TCRY conducts its operations includes the trackage previously referred to as the"Department of Energy Southern Connection" and track connecting thereto together with track within the Hanford Nuclear Reservation or "Hanford Site."

The Parties also have agreed that the work on the track on which TCRY conducts its operations is solely within the jurisdiction of the Union and HAMTC.
